Purpose:
This affidavit serves as an official declaration by the Traditional Authority (e.g., Chief or Headman) confirming the legitimacy of a home ownership claim, transfer, or occupancy within a customary area. It is especially required in cases where formal title deeds or land certificates are unavailable or where the transfer is governed under customary law.


When is this Required?

  • The property is allocated through traditional processes and not registered in the Deeds Office
  • The applicant is a beneficiary of inheritance within the community
  • There is a lack of formal documentation, but the Traditional Authority recognizes the claim
  • To support dispute-free land transfers based on customary rights

🖊️ Contents of the Affidavit Must Include:

  • Full name and ID number of the applicant (new owner)
  • Description of the property or land being transferred (location, size, boundaries)
  • Name(s) of current or previous occupant(s)
  • Confirmation that the Traditional Authority recognizes the transfer or ownership
  • Statement that the property is not under dispute
  • Signature, name, and official stamp/seal of the Traditional Authority
  • Date and community name or tribal office details
